Competition Rules

These rules govern how the competition is conducted, and the conditions associated with participation.

"You" or "Participant" refers to competition participants.

"Admins" refers to the organizers of the challenge as shown on usm3d.github.io (JL, DM, ID, TB, HC, CK, DG).

"Sponsors" refers to the competition sponsors, or providers of the data the competition is based upon.

"We," "Us," or "Organizers" refers to the "Admins" or "Sponsors" or both as appropriate context requires.

By participating in this competition, you accept these rules and these rules form an agreement between You and the Organizers.

This is a skills-based competition and chance will play no part in determining prize winners. All eligible entries will be evaluated using the criteria shared on the competition page.

I. Eligibility

The competition is open to:

  1. individuals over the age of 18;
  2. residents or citizens of jurisdictions that are not restricted by U.S. export regulations or OFAC sanctions. Other local rules and regulations may apply to You, so please check your local laws to ensure that you are eligible to participate in skills-based competitions. We reserve the right to forego or award alternative prizes where needed to comply with local laws;
  3. persons that are un-affiliated with, or non-family members of the Organizers; AND
  4. persons that are not involved in the administration or execution of the competition.

Ineligible participants that submit entries are still subject to the remainder of these rules.

II. Entry

To be eligible for prizes, an entry must be submitted in accordance with the instructions listed on the competition page.

III. Condition of entry

  1. You grant Us an irrevocable, perpetual, worldwide, fully paid license in any submitted materials in an entry to use, reproduce, distribute, publicly display, modify, and make derivative works.
  2. You agree to execute any documentation, prepared at Organizers expense, to make use of the rights granted above.
  3. You understand that the Organizers or other Participants may have developed or submitted materials similar or identical to You, and You waive any claims You may have related to similar entries or Organizers related work, now known or later developed.
  4. By entering into this competition, You agree that You will not receive any compensation or credit for any use of Your entry, other than as described in these rules.
  5. You agree to release and hold harmless the Organizers and any of their affiliates, directors, employees, or agents from any and all liability, injury, loss, damage, action or claim, including attorneys' fees, alleged from or arising out of Your entry into this competition or prize money.

V. Prizes

-- To be awarded at the discretion of the competition Admins, unlike the main prizes (which are based on leader board position).

If for any reason the prizes are unavailable or cannot be awarded by law, We reserve the right to substitute a prize with an alternative of equal or greater value as determined at the time the competition ends. You may not designate an alternative recipient for a prize, We reserve the right to award an alternative Participant in the event you do not accept a prize. You are responsible for all applicable taxes or duties related to accepting a prize. By accepting a prize, you agree that We may use Your name, and other reasonable identifiers in connection with publicizing this competition, without payment or compensation to You. In any case, the lack of such consent does not prevent the winner from receiving the prize.

VI. Notice

Any changes to these rules will be posted on the competition website as they are made.

VII. Venue

This competition and these rules will be governed by the laws of the state of California and you consent to the exclusive jurisdiction of, and personal jurisdiction for, the courts of the county of San Francisco.

VIII. Liability

TO THE MAXIMUM EXTENT ALLOWABLE UNDER APPLICABLE LAW, THE LIABILITY OF THE ORGANIZERS OR THEIR RESPECTIVE AFFILIATES, DIRECTORS, EMPLOYEES AND AGENTS ARISING FROM OR IN CONNECTION WITH THIS COMPETITION, IN NEGLIGENCE OR ARISING IN ANY OTHER WAY OUT OF THE SUBJECT MATTER OF THESE CHALLENGE RULES, WILL NOT EXTEND TO ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES OR LOSSES, OR ANY LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF CONTRACTS OR OPPORTUNITY, WHETHER DIRECT OR INDIRECT, EVEN IF YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF THOSE DAMAGES OR LOSSES ARISING OR IF THEY WERE OR ARE WITHIN CONTEMPLATION AT THE DATE OF THESE CHALLENGE RULES.

TO THE MAXIMUM EXTENT ALLOWABLE UNDER APPLICABLE LAW, THE MAXIMUM AGGREGATE LIABILITY OF THE ORGANIZERS OR THEIR RESPECTIVE AFFILIATES, DIRECTORS, EMPLOYEES AND AGENTS ARISING FROM OR IN CONNECTION WITH THIS COMPETITION, WHETHER IN CONTRACT OR TORT OR ARISING IN ANY OTHER WAY OUT OF THE SUBJECT MATTER OF THESE RULES WILL NOT EXCEED ONE HUNDRED UNITED STATES DOLLARS ($100).
